Privacy Policy
This privacy and cookie policy is drawn up pursuant to articles 13 and 14 of the European Regulation 2016/679 (the “GDPR”) and of the international, European and Italian laws concerning the processing of personal data, in each case to the extent that they are applicable from time to time, together with their respective amendments and additions (collectively, together with the GDPR, hereinafter, also the “Applicable Law”).
This privacy and cookie policy applies only to the website www.hoopsrl.it. Therefore, it does not therefore apply to any other website that may be consulted by the user via links.

The owner of the personal data treatment

The data controller of personal data is Hoop S.r.l. , with headquarters in Milan, via V. Monti 47, tax code and VAT number no. 11203510968 (PEC hoopsrl@pec.it) (the “Data Controller“).

Types of data processed and purpose of the processing

Navigation data

Navigation data Access to the site involves the recording of data used for the sole purpose of obtaining statistical information or to guarantee correct functioning.
The data collected includes the IP addresses and/or domain names of the computers used by users who connect to the Site, the addresses in URI (Uniform Resource Identifier) notation of the resources requested, the time of the request, the method used in submit the request to the server, the size of the file obtained in response and other parameters relating to the user’s operating system and IT environment.
These data are not collected for the purpose of associating them with identified subjects, however due to their nature they could allow users to be identified through processing and association with data held by third parties if it were necessary to ascertain responsibility in the event of hypothetical computer crimes perpetrated through the Site.
The data used for the sole purpose of obtaining anonymous statistical information on the use of the Site and to check its correct functioning are kept for the time necessary to carry out the analysis and comparative statistical processing activities, not exceeding 7 days, except for any need for investigation of crimes by the competent authorities.

Data provided voluntarily by the user

The optional, explicit and voluntary sending of messages to the contact addresses of the Data Controller (also by e-mail), the compilation of forms and contact forms, the registration in restricted areas and/or services offered by the Data Controller through the Site or the requests formulated from time to time by the user through the Site, involve the acquisition of the user’s contact details, including the sender’s address, necessary to be able to satisfy the requests, as well as any other personal data entered in correspondence.
In this case, the acquired data will be processed exclusively to respond to user requests, for example, on the use of a service. In order to better contextualize the question, users can be contacted via email, by telephone or through other communication systems by an operator. These personal data will be kept for the time necessary to satisfy the requests received or for the execution of the contractual relationship with the user. In any case, such personal data may be kept for a period not exceeding 100 days following the satisfaction of the requests received from the user or the termination of the contractual relationship.
The data will not be communicated to other subjects, nor will they be disclosed to third parties except for statistical purposes, in respect of anonymity.

Cookies and other technologies for reading/storing information on the user’s terminal

The Data Controller may use cookies (small text files transferred from the web server to the user’s computer) and other technologies for reading and/or storing information on the user’s device such as fingerprinting, email trackers or clear GIFs/Beacons , whose purpose is to inform the server about the user’s access to that specific page of the Site, and of any other information that it obtains from the readable parameters of the system through functions contained in the page of the Site, to personalize and facilitate the browsing experience of users and, in some cases with their prior consent, to enrich user profiling for advertising and/or commercial purposes. Cookies can be “temporary” (or session, they are canceled at the end of the connection) or “permanent” (remain on the user’s hard drive, unless the user deletes them himself). It is possible to manage/deactivate cookies directly from the browser settings, or through the portal http://www.youronlinechoices.com/it/. The use of additional persistent cookies and session cookies (which are not stored permanently on the user’s computer and disappear when the browser is closed) is strictly limited to the transmission of session identifiers (consisting of random numbers generated by the server) necessary to allow safe and efficient exploration of the Site. The session cookies used by the Site avoid the use of other IT techniques that could potentially compromise the privacy of users’ browsing and do not allow the acquisition of personal identification data of the user. Purpose of the treatment

–  Navigation data and data provided spontaneously by the user may also be processed by the Data Controller:
subject to obtaining specific consent from the user, for purposes related to the performance of commercial information and/or marketing of the services provided by the Data Controller; and/or
–  for purposes related to the fulfillment of obligations established by applicable laws and/or regulations, as well as by provisions issued by the competent supervisory and/or control authorities/bodies.

Methods of processing personal data

The processing of personal data:
(i) is carried out by means of the operations or set of operations indicated in art. 4, co. 1, no. 2 of the GDPR;
(ii) is also carried out with the aid of electronic or automated means. In this regard, we inform you that the personal data processed through the use of electronic or automated means are stored in electronic archives located on servers located in Italy;
(iii) is also carried out through the use of fax, e-mail or other remote communication techniques.

The processing of personal data is also carried out through the use of cookies. In this regard, please refer to the “Cookie Policy”, available below.

Provision of personal data and legal basis of the treatment

Without prejudice to the right of the interested party to provide personal data to the Data Controller, the provision of personal data can be:
–  mandatory for the use of the services offered by the Data Controller;
– optional for purposes related to the performance of commercial information and/or marketing of the services provided by the Data Controller; And
– mandatory for purposes related to the fulfillment of obligations established by applicable laws and/or regulations, as well as by provisions issued by the competent supervisory and/or control authorities/bodies. Any refusal by the interested party to provide personal data to the Data Controller could make it impossible for the Data Controller to provide the requested services.

Communication, dissemination and transfer of personal data

Without prejudice to the communications made in compliance with legal obligations, all data collected and processed may be communicated for the aforementioned purposes to:
1. third parties, data processors on behalf of the Data Controller, for the execution of activities directly connected or instrumental to the provision and distribution of the services offered through the Site, or to other external consultants who assist the Data Controller in execution of the services requested by the interested party;
2. if the interested party has given his consent to the Data Controller, to third parties and/or associated companies for purposes related to the performance of commercial information and/or marketing activities for the services provided by the Data Controller.

Personal data are not subject to disclosure. With reference to the purposes of the processing indicated above, personal data are not transferred to non-EU countries.

Rights of the interested party

The subjects to whom the personal data refer have the right to exercise the following rights: (i) ask the Data Controller to confirm the existence of their personal data, the origin of such data, the logic and purpose of the processing, of the categories of subjects to whom the personal data may be communicated, as well as the identification details of the Data Controller and of the data processors; (ii) request access to personal data, transformation into anonymous form, blocking, rectification, integration or cancellation of the same, or limitation of treatment; (iii) object to the processing in the cases provided for by the Applicable Law; (iv) exercise the right to portability, within the limits established by art. 20 of the GDPR; (v) revoke the consent (where this is the necessary legal basis for the processing) at any time without prejudice to the lawfulness of the processing based on the consent given before the revocation; and (vi) lodge a complaint with the Guarantor for the Protection of Personal Data (the “Guarantor”), following the procedures and indications published on the Guarantor’s website at the address: www.garanteprivacy.it
Any rectifications or cancellations or limitations to the processing carried out at your request – except where this proves impossible or involves a disproportionate effort – will be communicated by the Data Controller to each of the recipients to whom the personal data have been transmitted. The Data Controller may inform you of these recipients if you request it.

Cookie Policy

This cookie policy is issued by the Data Controller (as defined above) in a simplified manner as required by the provision of the Guarantor (as defined above) issued on 8 July 2014 “Identification of simplified procedures for the information and the acquisition of consent for the use of cookies”.

Cookie overview

Cookies are small text files that a website can send, while browsing, to the access device (PC, notebook, smartphone, tablet, etc.). They are usually managed directly by the browser used for navigation and recorded directly on the device. The same website that transmitted them can subsequently read and update them so that some information and user preferences (such as login data, the chosen language, font size, other display settings, etc.) must be indicated again when the user returns to visit said site or navigates from one page to another of it.

The Applicable Law (as defined above) divides cookies into two macro-categories, technical ones and profiling ones.

Technical cookies include:

Different speech however, for the so-called “profiling” cookies, i.e. those aimed at creating profiles relating to the user and used in order to send advertising and/or marketing messages in line with the preferences expressed by the same in the context of navigation in net.

For these cookies, the Applicable Law provides that the user must be adequately informed about their use and thus express their valid consent.

Profiling cookies also include those called “third parties”, i.e. cookies from sites or web servers other than the access one. A notable example is the presence of social plugins for Facebook, Twitter, Google+ and LinkedIn. These are parts of the visited page generated directly by the aforementioned sites and integrated into the page of the host site. The most common use of social plugins is aimed at sharing content on social networks.

The “technical cookies” used on this site avoid the use of other IT techniques potentially prejudicial to the privacy of users’ browsing and do not allow the acquisition of personal identification data of the user.

Acceptance and opt-out of cookies

By continuing to browse the site, closing the information folder or clicking on any part of the page or scrolling to highlight further content, you accept the Data Controller’s Cookie Policy and cookies will be set and collected. In case of non-acceptance of cookies by abandoning navigation, any cookies already registered locally in your browser will remain registered there but will no longer be read or used by the Data Controller until a subsequent and possible acceptance of the Cookie Policy.
